Terms & Conditions – Auckland Sightseeing Tours
By booking or participating in any Auckland Sightseeing Tours activity, service, or experience (“tour”), you (“passenger” or “you”) agree to the following Terms & Conditions. These Terms are legally binding and governed by New Zealand law, including the Contract and Commercial Law Act 2017 and other applicable regulations.
Auckland Sightseeing Tours (“we”, “us”, “our”) offers a variety of sightseeing tours, day trips, cruises, hop-on hop-off services, and other activities. Some services are provided by third-party operators. These Terms apply to all bookings, website interactions, services, and tours offered by Auckland Sightseeing Tours, whether provided directly or through third-party operators.
PRICE INCLUSIONS
Some entrance fees for activities or destinations visited during the tour, may be included in your booking.
Meals where indicated in your booking.
Snacks and refreshments provided during the tour.
Guided commentary and tours through points of interest included in the itinerary.
Transportation by tour vehicles as specified in your booking.
Passengers are advised that alcohol consumption is strictly prohibited on all tour vehicles and during all guided activities for safety reasons, unless explicitly stated otherwise.
PRICES
Goods & Services Tax (GST) at 15%.
Overnight or multi-day tours must be paid in full at the time of booking.
Quoted prices do not include credit card fees of up to 2.9% of the tour value or a minimum of $3.
Prices are subject to change without notice; confirmed bookings are protected from price changes.
CREDIT CARDS
We accept Visa, MasterCard, and American Express.
Personal cheques are not accepted.
Credit card transactions are subject to a non-refundable 3% fee.
LANGUAGES
English commentary is provided by the driver or guide on points of interest en route.
Other languages may be available upon request, subject to availability.
CONDITIONS OF TRAVEL
Auckland Sightseeing Tours reserves the right to alter fares, itineraries, transport, accommodation, or tour services if required.
In the event Auckland Sightseeing Tours is unable to operate a tour, an alternative operator may be provided, or a full refund will be issued.
Tours may have minimum operational numbers; if the minimum is not met, the tour may be canceled, rescheduled, or an alternative operator provided.
Auckland Sightseeing Tours is not responsible for property loss, damage, injury, or death arising during the tour or from services provided by third parties.
Optional activities carry inherent risk; passengers acknowledge that they participate at their own risk.
Auckland Sightseeing Tours is not responsible for loss, injury, or damage caused by circumstances outside its control, including fire, mechanical failure, civil disturbances, theft, weather events, or itinerary changes.
No refunds are issued for unused portions of tours.
Passengers must remove personal items from tour vehicles; Auckland Sightseeing Tours is not responsible for items left behind.
Auckland Sightseeing Tours reserves the right to remove passengers from tours for detrimental behavior or alcohol consumption without refund.
During busy seasons, accommodation may be limited; alternate arrangements may be suggested, including itinerary adjustments or revised departure dates.
Tours are subject to availability and may not operate daily.
In case of vehicle breakdowns, Auckland Sightseeing Tours may alter the itinerary; compensation may be considered for delays exceeding 2 hours.
Auckland Sightseeing Tours is not responsible for additional travel costs resulting from cancellations or rescheduling.
CANCELLATION POLICY
Day Tours: Full refund if canceled at least 24 hours before scheduled departure.
Multi-Day Tours: Full refund if canceled at least 72 hours before scheduled departure.
Tours including third-party transport (e.g., trains): Amendments or cancellations at least 72 hours prior are free; within 72 hours may incur 100% cancellation fee per supplier policy.
Custom/Private Tours: Cancellation terms specified at the time of booking.
Free Changes: Passengers may request date or itinerary changes, subject to availability.
Refunds: No refunds outside specified cancellation windows. Credit card fees are non-refundable.
HEALTH & SAFETY – RISK & DISCLOSURE
All tours have inherent risks, including physical activity, uneven terrain, water activities, adventure elements, remote locations, and rapidly changing weather.
Passengers must ensure appropriate clothing, footwear, and fitness levels for the tour.
Passengers must disclose any health or fitness concerns that may affect their participation within 12 hours of booking.
Auckland Sightseeing Tours reserves the right to cancel or alter participation if health, fitness, or behavior risks safety or tour operations.
Auckland Sightseeing Tours is not responsible for health and safety during third-party activities. Passengers must adhere to third-party safety rules.
Alcohol consumption during tours or activities is strictly prohibited, unless otherwise stated, to ensure passenger safety and compliance with New Zealand laws.
By participating, passengers acknowledge all risks associated with the tour and agree to take responsibility for personal safety.
LUGGAGE POLICY
All luggage must be clearly labeled with name, address, contact, and destination.
Checked luggage: Up to 2 pieces per person; 1 large (max 25 kg, max dimensions 158 cm total) and 1 small (max 7 kg). Additional or oversized luggage may be refused or incur a $40 fee.
Wheelchairs, mobility scooters, or collapsible baby pushchairs may count as 1 piece if they meet size requirements; otherwise considered oversized.
Carry-on luggage: Handbags, umbrellas, walking aids permitted. Passengers are responsible for all carry-on items; Auckland Sightseeing Tours is not liable for loss or damage.
Prohibited items, unaccompanied parcels, and items breaching NZ law are not allowed. Auckland Sightseeing Tours may refuse travel or luggage storage.
IMAGE USE & PRIVACY
Passengers consent to photographs, video, or audio recordings during tours.
Auckland Sightseeing Tours may use images for marketing, advertising, promotions, digital content, print, social media, or other media now known or developed.
Images may be altered, combined, or incorporated into marketing materials.
Passengers may request access or correction of images, but alterations may not be possible if materials are already published.
THIRD-PARTY SERVICES
Some services may be provided by third-party operators (transport, accommodation, attractions, activities).
Auckland Sightseeing Tours is not responsible for delays, cancellations, damages, or operational failures caused by third parties.
Passengers must follow third-party rules and safety guidelines.
LIABILITY & RISK
Participation is at your own risk. Auckland Sightseeing Tours is not liable for:
Personal injury, accidents, or illness.
Loss, theft, or damage of personal property or luggage.
Delays, rescheduling, or cancellations due to third-party services or force majeure.
Adventure or optional activities carry inherent risks; passengers acknowledge and accept these risks.
BEHAVIOR & RESPONSIBILITY
Passengers must act responsibly and not disrupt other passengers, guides, or operations.
Auckland Sightseeing Tours may remove passengers for disruptive behavior or alcohol consumption without refund.
Passengers are responsible for following all instructions, maintaining personal safety, and safeguarding personal belongings.
GOVERNING LAW & DISPUTES
These Terms are governed by New Zealand law.
Any disputes will be addressed under New Zealand jurisdiction.
PRIVACY
Personal information is collected, used, and disclosed in accordance with our Privacy Policy ([link]).
By booking or participating, passengers consent to collection and use of personal information as described.
